Buying a Property for your SMSF – Why Use a Buyers Agent


I openly admit that I am not an expert in choosing properties (indeed my own personal history with property investing is dismal to say the least but improving!). I work on the structure and strategy with my clients and recommend they do their own in-depth property research or lately I have been recommending people use a Buyer’s Agent if they are inexperienced or lack confidence, time or want help and advice but need to know that person is working 100% on their behalf.

That brings me to the title of this blog and I asked a local Buyer’s Agent here in the Hills District of Sydney who operates countrywide to explain the role and benefits of a Buyer’s Agent.  So here is our first Guest Post from Jay Anderson of Jay Anderson – Property Strategist | Buyers Agent | Property Advisor

    If I am a buyer’s agent can I charge my SMSF for services rendered in the purchase of a property (at market rates of course)?

    • Great Question Amanda and a sceanario that has becoem a major issue over the last few years with unpopular rules from the ATO. You shoudl read up on Mon-Arms Lenght Income (NALI) and Non-Arms Lenght Expenses (NALE).       One important excerpt from my reading:

      “Where the ruling really does draw the line, however, is services that are provided by the trustee where they are required to hold a licence or a qualification in order to provide that service or the service that’s being provided is covered by insurance policy, according to Mr Burgess.

      “In those situations, the individual of the trustee will be considered to have provided that service in their individual capacity, and it will be important in those situations for the trustee to charge a fee for the service provided or run the risk that the income from that asset will be treated as NALI,” he explained.” full article here https://www.smsfadviser.com/news/20261-ato-releases-final-ruling-on-nali

      I would recommend that you approach your SMSF Auditor and ask them what they would require from you if you are to charge your fund for your services as a Buyer’s Agent and also what their concerns would be if you didn’t charge your fund?

      I can’t give you a specific answer as i do not know your full circumstances.
